Awujale: KWAM I withdraws suit against Ogun as court declines interim injunction

Popular musician, Wasiu Ayinde Adesanya Marshal (aka KWAM I) has withdrawn his suit before Ogun State High Court in Ijebu Ode against the Ogun State Governor Dapo Abiodun and six others, asking court to restrain the government from taking any further steps in the process of selecting the next Awujale of Ijebuland pending the determination of his suit.Awujale: KWAM I withdraws suit against Ogun as court declines interim injunction
KWAM I is challenging the Awujale succession process, citing alleged breaches of the Ogun State Chieftaincy Law and violation of his constitutional right to fair hearing as enshrined in the 1999 Constitution (as amended).
The lead lawyer to KWAM I, Dr Wahab Shittu (SAN), filed the Notice of Discontinuance dated December 22, 2025 while the application was acknowledged by the court on the same date.
The music maestro had filed the suit marked HCJ/238/2025 against Governor Abiodun and named the Executive Chairman, Ijebu Ode Local Government; the State Commissioner for Local Government & Chieftaincy Affairs, the Ogun State Attorney General & Commissioner for Justice; the Secretary, Ijebu Ode Local Government; the Chairman, Awujale Interregnum Administrative Council and the Chairman, Funsengbuwa Ruling House, Otunba Lateef Owoyemi as co- respondents to the suit.
The application reads in part, “TAKE NOTICE that the Claimant/Applicant herein wholly discontinues the above suit against the Defendant/Respondent pursuant to Order 23 (or relevant Order) of the High Court of Ogun State (Civil Procedure) Rules 2024 and under the inherent jurisdiction of this Honourable Court.”
Shittu further disclosed the reasons for the withdrawal of the suit, saying that correspondences between the Chairman of Ijebu Ode Local Government and KWAM I necessitated the discontinuation of the suit.
Shittu said, “The Applicant (KWAM I) filed this suit following correspondences from the 2nd Respondent (the Chairman of Ijebu Ode Local Government) wherein 2nd December, 2025- which correspondences have been withdrawn.
“The Applicant respectfully prays that the Honourable Court to record the discontinuance of this suit and makes orders as it deems fit.”
Meanwhile, Justice AA Omoniyi of Ogun State High Court in Ijebu-Ode has declined to grant an interim injunction sought by KWAM I.
The Fuji musician had asked the court to grant the interim injunction, restraining the Ogun State Government and the six other respondents from taking any further steps in the process of selecting the next Awujale of Ijebuland, pending the determination of his suit.
But in his ruling on the application on Monday, Justice Omoniyi held that the interim injunction by KWAM I lacked merit.
Justice Omoniyi consequently ordered an expeditious hearing of the substantive matter and adjourned the case till January 14, 2026 for further hearing of the suit.
